1. Accepting these terms

By using this website you agree to these terms. If you don't agree with them, please don't use the site. The site is operated by Shane van Huizen, a licensed Arizona real estate salesperson (ADRE SA710418000) affiliated with Real Broker AZ, LLC.

2. What this site is — and isn't

This is a personal website. It exists to explain who I am, how I think about property, and what options exist when someone owns a home or wants to. It is marketing and it is education. It is not a transaction platform, and no offer, acceptance, listing agreement or representation agreement is formed through it.

3. Not legal, tax, or financial advice

Several of the paths described on this site touch tax, legal and lending territory. I'll walk you through the options and what each one generally means. I am not an attorney, a CPA, a tax adviser, or a mortgage lender, and nothing on this site is advice from one.

Before you sign anything or make a decision with tax or legal consequences, get your own professional to look at your specific facts. That's the line, and I don't cross it.

4. No agency relationship until it's in writing

Reading this site, submitting any form on it, subscribing to the newsletter, calling me, or texting me does not create an agency, fiduciary, or client relationship. Under Arizona law, agency arises only through a written agreement. Until such an agreement is signed, I owe you honesty and fair dealing — not the duties owed to a client.

Anything you send me before an agreement is in place should be treated as not confidential. If you're already represented by another broker under an exclusive agreement, please tell me; I have no intention of interfering with it.

5. Fair Housing

I comply with the federal Fair Housing Act, the Arizona Fair Housing Act, and the REALTOR® Code of Ethics. I do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, sexual orientation, or gender identity, and I will not answer questions about the demographic composition of a neighborhood — that's steering, it's illegal, and I won't do it. I'm glad to point you to objective, publicly available data sources so you can research any area yourself.

All properties referenced are offered on an Equal Housing Opportunity basis.

6. Property information and accuracy

Any property information, market commentary, price range, or figure on this site is provided for general information, is believed reliable but is not guaranteed, and is subject to change without notice. Market conditions move. Nothing here is an appraisal or a guarantee of value, rent, return, appreciation, or sale price.

Where listing content is displayed, it may be sourced from a multiple listing service and is subject to that MLS's terms, including its copyright and display rules. Listings held by brokerages other than mine are identified as such where required.

7. What you send me

Don't submit anything unlawful, misleading, infringing, or that isn't yours to send. Don't attempt to disrupt the site, scrape it at scale, or use it to send unsolicited commercial messages.

If you send feedback, a testimonial, or a suggestion, you grant me a non-exclusive, royalty-free right to use it in connection with my business. If you'd rather I didn't quote you, say so and I won't. I'll ask before using a named testimonial either way.

8. Intellectual property

The writing, photography, video, layout and design on this site belong to me or are used with permission. You're welcome to quote a passage with attribution and a link. Republishing substantial portions, or using the content to train a commercial model, requires written permission.

REALTOR® is a registered collective membership mark owned by the National Association of REALTORS® and is used here in its descriptive sense to indicate membership. It is not part of any business name, brand, or domain. The Real Broker name and logo belong to Real Broker AZ, LLC and its affiliates. The RIG name belongs to its owners. "Ask a REALTOR®" is used on this site as a descriptive heading for a video series and a physical sign — not as a service mark, DBA, or trade name.

9. DMCA — copyright complaints

I respect copyright, and property photography is one of the most commonly misused categories of work in this industry. If you believe material on this site infringes a copyright you own or control, send a written notice that includes:

• Your physical or electronic signature.
• Identification of the copyrighted work you claim was infringed.
• Identification of the material on this site you claim is infringing, with enough detail to locate it — a URL is best.
• Your name, address, telephone number and email address.
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.

Send it to shane@svhrealtor.com with "DMCA Notice" in the subject line, or call (928) 830‑7990. Material that is the subject of a valid notice will be removed or disabled promptly. If you believe material was removed in error, you may submit a counter-notice with the corresponding statutory elements. Knowingly making a material misrepresentation in either direction carries liability under 17 U.S.C. § 512(f).

10. Third-party links and services

This site links to other sites and relies on third-party services for hosting (Wix), typefaces and form delivery (Google). I don't control those sites or services and I'm not responsible for their content or their practices. Their terms and privacy policies govern your use of them.

11. Disclaimers and limitation of liability

This site is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. I don't warrant that the site will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, I am not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost opportunity, arising out of your use of this site or your reliance on anything published here. Nothing in these terms limits any liability that cannot lawfully be limited, and nothing here is intended to limit the duties I owe a client under an executed written agreement or under Arizona real estate law and the REALTOR® Code of Ethics.

12. Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising out of the site will be brought in the state or federal courts located in Maricopa or Yavapai County, Arizona, and you and I each consent to that jurisdiction. This clause governs use of the website. Any executed listing, buyer representation, or purchase agreement contains its own dispute-resolution terms, and those control over this one for matters within their scope.

13. Changes to these terms

These terms may change. The effective date at the top will change with them, and continuing to use the site after that means you accept the revision.
